I think he will dismiss it if forced to rule. Judges don't like going against another one unless they are sure that they are correct. We all know that a takings has occurred here. Even Lamberth acknowledged it. The problem is he could just go along with saying "Congress said I can't review this". How would the Supreme court react to this? Congress can just write a law and say, no one in the judiciary can review it? What? Do we only have two branches of the government? Checks and balances no longer apply?
