Hudson Bay only filed their lawsuit after Tom realized the mistake an amended the filing. They had already conducted their deal well in advance of that event by months, and will have a tough row to prove they relied on that mistake in financing Worlds. This is not the 1st 8k filed for a correction of this kind. Just about every Fortune 1000 has made an error in their filings.
Keep in mind Tom has done an excellent job at conserving cash to keep this enterprise afloat pending the Markman. After the Markman I'm sure his organization will increase in support of the lawsuit, and allow more oversight for these issues.
