Sorry, that is only applicable to the employees in California. It is not based on where the company is located. It is based on the employee location. In states such as Pennsylvania and many others noncompetes are valid. Companies don't wait to have competition before they start requiring employees to s
sign non-competes when they are hired.
Additionally, companies can go to existing employees and offer "consideration" (usually a nominal amount of $ or stock options) and request they sign a noncompete. The employee can either accept the consideration or leave the company.
I will check with a friend who works for Intuitive and see if they have non-competes. I'm 99% sure they do.
