Thanks for pointing it out ... but that statement by John Tucker in his tweet is so completely incorrect!!

There are many other structures that are similar to ACH 3422 but the old IDX drug valopicitabine is NOT a good comparator for ACH 3422 at all ... different group at 3-prime, different pro-drug, different base ... BTW, valopicitabine was put on clinical hold by FDA in 2007 for unfavorable risk/benefit.

Further I want to point out ... ACHN has consulted two independent law firms both of which have noted that ACH 3422 has patentability, no patent interference and has freedom to operate.....I have looked into the claims and agree.....Note that ACHN has a good record with past patent applications in that all claims have issued in their patents to date.
