A waiver, or a Domestic Non-Availability Determination (DNAD) to the Berry Amendment may be granted if the Secretaries of the Army, Navy or Air Force, the Under Secretary of Defense for Acquisition, Technology and Logistics (USD(AT&L)), or the Director of the Defense Logistics Agency determines that items grown, reprocessed, reused, or produced in the United States cannot be acquired as and when needed in a satisfactory quality and sufficient quantity at U.S. market prices..

Please tell me which of the finer points of Section 2 isn't clear and I will gladly offer a further explanation.

Last time I checked,they were just notified on or around 8/20/14,that the patent they applied for has yet again been denied.

From the looks of things,it's going to be an uphill battle from here.


Please show me in the patent application letter mailed to Entogenetics,(8/20/14) where it would suggest otherwise.


They can't seem to get out of their own way.
