Glad they are avoiding a strike.
ABF Freight System, Inc. (“ABF”), the largest subsidiary of Arkansas Best Corporation (Nasdaq: ABFS), is providing an update on the most recent information related to ABF’s contract with the Teamsters (“IBT”). ABF and the IBT have agreed to another extension of ABF’s current labor contract through November 2, 2013. A copy of the update is furnished as an exhibit to this Report on Form 8-K.
Apparently there was a vote to strike. Looks like ABF is buying enough time to give the Teamsters what they want.
I've been wondering the same the thing. Wonder what's the recent stimulation? Profits made in the last quarter?

ABF Freight System’s $750 million lawsuit against the International Brotherhood of Teamsters and YRC Worldwide has again been rejected by a federal court.
The U.S. Court of Appeals for the Eighth Circuit affirmed a lower court ruling to dismiss the case, which had attempted to overturn YRC Worldwide’s wage-cutting agreements with the Teamsters union. It marks the third time the case has been dismissed. The lawsuit, which was first filed by ABF, No. 6 on JOC’s list of the Top 25 Less-Than-Truckload Carriers, in November 2010, was dismissed for a second time by U.S. District Court Judge Susan Webber Wright of the Eastern District of Arkansas, on Aug. 1, 2012.
“ABF is disappointed in the court’s ruling and the fact that YRC received three rounds of concessions from the IBT that ABF did not also receive,” the company said in a written statement. “ABF is assessing the opinion and determining whether to pursue additional options.”
Meanwhile, YRC Worldwide, No. 4 in JOC’s Top 50 Trucking Companies ranking, has applauded the ruling:
“We anticipated this outcome and are pleased with the court’s decision and supporting opinion,” said Michelle Friel, executive vice president, general counsel and secretary of YRC Worldwide, in a written statement.
The Teamsters union has mailed ballots to authorize a strike against ABF Freight System by its employees covered under the Central Region Local Cartage supplement. The comapny said it was notified of the mailing on Oct. 8.
The supplement is one of 27 to the ABF National Master Freight Agreement. After “many months” of negotiations between the two parties, a five-year contract deal was reached and ratified in June by the majority of ABF Teamster employees, according to ABF, No. 6 on JOC’s ranking of the Top 25 Less-Than-Truckload Carriers. Since then, 25 of 27 supplemental agreements have also been ratified. The two that remain are Western Office Part 5 and Central Region Local Cartage.
For Central Region Local Cartage employees, ABF has provided its “last, best and final offer,” the LTL company said. The Teamsters constitution provides a process in which its national negotiating committee conducts a strike authorization vote in the affected supplemental area only in order to establish whether the committee has the authority to conduct a strike.
ABF is encouraging employees covered by the Central Region Local Cartage supplement to vote “no” to the strike authorization and to “let their voices be heard by making sure they exercise their right to cast a ballot,” according to the company. ABF also said it is aware that the Teamsters have also encouraged its Central Region Local Cartage members to vote “no” to a strike in a letter they mailed to employees.
If a strike is nonetheless authorized by employees in Central Region Local Cartage and directed by the committee, there can be no strike before Oct. 29, which is the end of the expiration of the current contract extension, ABF said. ABF noted that it is preparing for this outcome.
Meanwhile, the company said concerns in the Western Office area “have been addressed,” and it is “hopeful” that ratification will occur in the short term following “minor, non-economic” modifications to that supplement.
Teamsters Send ABF Strike Authorization Ballots to Some Members
The Teamsters union notified ABF Freight System that strike authorization ballots are being sent Oct. 8 to workers covered by a Central Region supplemental agreement that has been voted down twice.
The so-called Central Region Cartage supplement was the largest of seven side agreements that were initially turned down when union members approved a five-year contract in June. The ballots are set to be counted Oct. 29.
The strike authorization vote is mandated by the union’s constitution after ABF presented its “last best and final offer” to win ratification of the Central Region supplement, the company said in a statement.
The contract, calling for an initial 7% wage reduction, can’t take effect until all side agreements are approved.
The prior contract has been extended since June to give negotiators time to resolve differences.
Five of the seven side agreements were approved after being renegotiated. The other side agreement that hasn’t been ratified covers Western Region office workers.
ABF said that “concerns in the Western office area have been addressed, and ABF is hopeful that ratification will occur in the short term.”
In the Central Region re-vote during August, 56% of members turned down the renegotiated deal.
“ABF is encouraging employees covered by the Central Region Local Cartage supplement to vote ‘no’ to the strike authorization and to let their voices be heard by making sure they exercise their right to cast a ballot,” said the company statement.
The union didn’t respond to requests for comment.

No to be clear - I am responding to the comment made that YRCW can not acquire anyone because of an agreement with Hoffa. That I do not believe is fact based and was looking for substantiation of that statement.
My bet is YRCW is now looking to acquire because it makes real sense in terms of further supporting the network optimization initiative.
I have no idea whether ABFS is a likely candidate other than I think it could be a very good fit and the comments made by both organizations leadership.
I wouldn't be surprised to see an acquisition soon based on those facts.
Just to be clear, are you saying that YRC is going to acquire ABF very soon? If so, what makes you think this? What makes you think YRC has the buying power to do this? You do know that they currently have over $1 bil in debt right? They also currently have a 15% wage concession that will elminate the small margin of profit that is/will be made when their current contract expires. Also, word on the street is YRC is already working with the IBT to get a contract extension. I have a feeling that will go over like a lead balloon with YRC drivers. I see a pretty nasty contract negotiating period in their near future.
That's ridiculous never in my life have I seen a union agreement with that kind of provision in it. Please substantiate this comment. My bet it you will an acquisition very soon, makes sense to further enhance the payback on a network optimization initiative - re synergies would be significant.
Man this thing has been all over the place last few days. What's people's take? I'm thinking if it hits 27 I'm going to be exiting for a bit. It's a good thing I didn't set a stop loss here, I'd have gotten culled last week when it slid.
Something going on in US trucking, as we just had 2 OTR drivers who lost their jobs last Monday when theyw ent to check in for new scheduels, and were told, the compnay they wroekd for was acquired quietly over weekend by another firm and all drivers were NOT being taken by the acquiring compnay, so all thsoe drivers are out of jobs, which two happen to be customers we just sigend work contracts with and now cannot do the projects due to losing their jobs without any warning!
I think he is talking about the lawsuit ABF had against the IBT for concessions awarded to YRC when they were on the brink of bankruptcy. The lawsuit has been appealed multiple times, but was dismissed this past Friday. If he is thinking that YRC will sue ABF for defamation, I think he will be very disappointed that it will not be worth more than ABF is worth, and that it would probably cost more money to pursue than the reward. I'm not a legal expert, but that's my take on it.

THE most terrible thing that could have happen to abfs was to approve concessions.the funny thing is welch scared them into it w/ his offer.never would have passed w/ out that offer.now court case is over,potential return suit for damages,abfs what you gonna do when they come for you!you cant have it both ways.

Your source is wrong. The ABF NMFA is a done deal. It's a wrap. However, they are still voting on some supplemental contracts that didn't get passed.
My source tells me there is a discrepancy on the vote. From what I understand casual employees and the retired were sent ballots. Of course the retired and casual employees would vote “YES”.
If this is true, all will have to vote again.

Why would I be jealous and what would I be jealous of? The consensus of everyone was that it was going to be close but you were posting that we didn't know the union very well and that UPS voted theirs down with no concessions, etc. Whatever. I'm not the one gloating. You were the one taking credit and gloating when you were more wrong that right. I'm sure you know a lot about ABFS. I happen to know someone who knows the company like the back of his hand and he was confident they'd get the deal done. Best of luck on your future investments, short or long.
