FDA has indicated that it intends to do so, the regulatory impact could have adverse consequences to our business.

The Food & Drug Administration (the “FDA”) is permitted to regulate electronic cigarettes as “tobacco products” under the Family Smoking
Prevention and Tobacco Control Act of 2009 (the “Tobacco Control Act”).
