You're correct that those risks have to be stated. However a common concept in the healthcare industry is "does the benefit out way the risk?" That is truly the deciding factor on a product being developed.
Look at all those drug commercials. Risks up to and including death for some of them yet they were approved for a certain indication. Nothing is without risk.
