Can't sue the government without their permission . I'm betting they would say no . On the other hand I'd think Obama Care would be in favor of still collecting the federal tobacco taxes with spending less on related heath care cost.

How long before someone sues the FDA for having a healthier solution available for smokers but not making it available? Do I hear class action from smokers who get cancer? Surely some lawyer has got to pick up on the mega millions.

Exactly... and if the FDA were smart they would get off their butts, but I'm not holding my breath... just exhaling.
