Exactly. I've always thought that a pragmatic compromise would make all sides coming out smelling like a rose. But, Obit may weigh in on why this might not happen, legally, that is.

401kobessive - both sides are all in on this. I used to think there would be mediation; that would be logical, but rationality has very little to do with this anymore.

Interesting note

Indeed I did not think of that - and indeed that is common in 11 cases - before arguments

Maybe as Sweeney sees two very different DISCOVERY motions she will demand that they either negotiate a settlement or at minimum come back with a combined discovery --- or something like that

i.e. it is not too late for her to tell them to select a mutually acceptable mediator and to meet 5 timew with the mediator to try and reach a settlement
