Maybe, but, read it again. It is written from the judges perspective, not from the plaintiffs.

Judges do not want plaintiffs writing orders for them, they want to make their own decisions in their own words. If the judge agrees with the plaintiff, they are perfectly capable of saying "judgement for the plaintiff".

It is possible, however, that this is some sort of "proposed summary judgement", where the plaintiffs and defendandant have agreed to this proposal, and it is waiting on the judges approval.

And, the plaintiffs typed up the proposal for the judges approval. However, it is difficult to think of a situation where the plaintiffs and defendandts agree but the judge will nix said idea, that is, if the judge did not already approve this, but we just have not been so informed.

I have asked Obit to comment on this, and, we need to be patient and give him time to read it on his schedule. I would humbly recommend you consider Obit's comments to be more credible than mine, in that he obviously has more experience and expertise in the legal area than the rest of us.
