If your Microsoft, Google, etc, your probably not too worried about VPLM taking you to court. However, If VPLM patents are as good as they say they are, you should be worried about VPLM being bought out by one of these big competitors that is big enough to take you to court.
If the BOD are doing there job, they are talking to as many companies behind the scenes and like they have said, create a bidding war.
