How can it get more obvious than that? No grey area there, folks. And I've seen other examples as well of using the higher dosages of MTX for medical purposes prior to Medac's patent application being filed, as in years if not decades before.
Prior art exists for some indications but does it exist for higher SQ concentrations to treat auto-immune diseases?
I'm sure ATRS has a strong case but its also hard to believe this is a simple case which is going to be thrown out after a quick review. Medac filed their Patent Cooperation Treaty ( PCT) application in Jan/2008 so this might be a complicated case.
