Thanks for the information. I guess my question would be then why Worlds didn't argue these specific details in the MSJ hearing or in their latest request for a Markman. Am I missing something?

Thanks, nice summary and a silly technicality which won't be lost on the judge. Shouldn't have taken this long to issue a ruling even though it may be a precedent but probably doesn't affect 500 patents.
