Precedent is NOT only limited to the courts. One needs look no further than your own bank account to see that. Maintenance fees, minimum balances, checking account fees, ATM limits on withdrawal activity, ATM charges, etc., etc. used to be unheard of, now it's common practice everywhere.
Compromise doesn't set precedent. Precedent is created by cases with a final ruling.
