If that's true why on earth did Jerry go to them for help?

Empire Capital LLC has a bad rap for ripping off OTC companies.

Was he that desperate, or that stupid? Or is that just not accurate?

It certainly seems that RTXB is determined to give Empire lots of ammunition for this charge:

Management has made false, disparaging, and defamatory statements about Empire and Welch in press releases and on public websites, possibly exposing the Debtor to litigation for defamation and business disparagement;

- Management has attempted to interfere with Empire’s contractual relationships with other customers, totally unrelated to this bankruptcy case, causing Empire to expend significant assets to repair the relationships, and possibly exposing the Debtor to litigation for tortuous interference with contract.
