You forgot to include the original contract between the party's! You forgot to include the exhibits. You forgot to include the rebuttle argument from the defendant.

We all know how bad subcontractors are, then throw in a bankruptcy that can happen to anyone and there is that situation. Can't say there is fraud on that one since there was a settlement. But both party's on that one are probably to blame. Remember to bid the job for what it will actually cost you to do it; Because if you under bid to get the job and you don't have a cushion you only screw yourself and your business partners!
