IMO, ADR is the short-term key in the next few days. My theory is this based on the recent docket/pacer in California. Both Judge Denise Casper and Judge Consuelo Marshall may have been in communication regarding the outcome in Massachusetts. Both parties are currently in talks regarding the California matter, not necessarily may come to an agreement but will be countering for a few days. If both parties come to an agreement in California then the case will be dismissed. Why I think this may happen, well, Massachusetts trumps California matter and will have a bigger impact for both companies shareholders which judges have taken in consideration. I believe after California has been resolved an announcement from Massachusetts will conclude in favor of WDDD. Will this go to trial, who knows. I am a firm believer that ATVI will avoid a Markman hearing.
