smd1234 - I believe that rule keeps the IFX deal away from the jury. Nic wants everyone to believe that it keeps all of the previous license deals away from the jury, and the only things admissable would be the IFX deal and what huge companies charge.
That makes zero sense. To figure out what something is worth, you check to see what it has sold for recently. You look for similar items when you can't find the exact item you are looking for, or as a comparison of relative worth.
In the Rambus case, especially since the case is about past infringement, the royalty that other companies willingly agreed to pay Rambus IS relevant to the determination of past damages. Nic says it is not.
But nic's supposedly a lawyer, and I'm supposedly not.
