As I stated and I am sure that you know, every one of these up-ticks in the past have been met with dilution large enough to drive the PPS down to pre up-tick or lower levels. We need to stay vigilant and perhaps hold our breath. Last year there was a similar run on another stock in the KK stable. A PR was released indicating that there was no fundamental reason for it and the stock's PPS withered liked a punctured balloon.

And as far as being "right" much of the time I just take the contrarian position in order to get the cadets to respond -- "poking the turtle with a stick".

GERS' New Financing Deal

GERS landed a deal in December to repay YAGI $.5M in cash. To repay $1.5M between now and June, and to repay $1.8M in the 2nd half of this year. That's $3.8M total.

YAGI also agreed to 20% of any settlements.
With the way the PPS is acting, it appears this new deal with YAGI has dramatically reduced dilution allowing the PPS to finally breath. I think this new deal could be why Edward Carroll was promoted to CEO.

"On November 12, 2013, the Company and YA Global Investments, L.P., entered into an amended forbearance agreement pursuant to which the maturity date of the Company's outstanding debt to YA Global and its assignees (see Note 9, Debt Obligations, above) was extended to December 31, 2014. The amendment further provided for a mandatory prepayment of $500,000 on or before December 15, 2013, cash payments by the Company of $250,000 per month for the first six months of 2014, $300,000 per month for the second six months of 2014 and the reimbursement of certain legal costs and expenses. The Company will also be required to pay an amount equal to twenty percent (20%) of all gross proceeds received from any defendant in any patent infringement litigation, whether now existing or hereafter arising, within one (1) Business Day of receipt."
