You will notice that the motion filed by the SEC shows that Rooney and Solaris are the defendants, and that they also indicate that they are ALL of the defendants. Positron is not a party in this case and will not be subject to disgorgement. Ill-gotten gains are repaid by the defendants, no matter how, or to who, they were dispersed.
