Obviously there would never be a mutually agreed upon "settlement" for 2.5 million. If that was the figure being floated by Rosen, it would go to trial before RXPC would pay that amount.

The settlement amount will remain unknown until Dec.3 (?)

If there is some kind of deductible on the insurance, which I doubt... that would trigger BK.

But otherwise, the settlement won't trigger BK.

If Radient had to pay it, even $50,000 would trigger BK because Radient does not have a dime. The fact that Radient staggers on means they had full insurance.
