No. If a SEC investigation is still in the informal stage, FINRA has no means to prevent a CEO of a previously suspended grey, from bringing another stock company into the market. If the SEC has not filed litigation, it has no means to prevent a CEO of a previously suspended grey, from bringing another stock company into the market.

In an ideal world both regulatory agencies would force a CEO of a previously suspended grey to address the issues which caused the suspension. But alas, this is not an ideal world. QED
