It's designed to make the government look foolish. Gov't won't take the deal, which strengthens the hand of those filing lawsuits. This is not the real game, in other words.

Smart move. Courts will get exasperated with gov't and…then there's that 3rd amendment hanging out there…with a clearly disingenuous govt.
