MSFT did not settle for anything "substantial", thats why brst share price crashed after the announcement. Arguing in high levels of the court is very costly, MSFT's defence was the same as Apple's will be, put simply "been there, done that"
For MS and in some cases Apple, whether right or wrong, it is often less costly and more expedient to just pay off these schmucks and be done with it

Alt: Nope. There was considerable discussion of this here recently and evidence was convincingly submitted by Spitsong as well as a few others, later, the MS was caught in that case. They had ordered the deletion of all their email related to the subject. They had to settle because if they had gone to court they'd have been in huge trouble for destroying evidence. The settlement of MS with BRST is not representative of any situation any other company might be.
