So Fagen wanted a contract but Greenshift didn't accept it the way they wanted it and "they decided to sue before getting sued - implying the COES contract was implied"

So what does that say about all the other litigation? Nothing I think, just that even if someone wants to pay for using the GERS patents it is hard to get to a settlement and it takes a while.
