The Magistrate can't force a settlement, nor can the judge. They do, however, ALWAYS encourage settlement. You state:

"If HJJ wants to "encourage" a settlement he will rule on the w/a quickly to give the settlement meeting by G and V to have some teeth."

That ain't gonna happen. The settlement conference with the Magistrate will occur before HJJ ever makes a ruling on the RR percentage. You can take that to the bank.

A settlement between VRNG and GOOG could happen at any time, but it's not likely. They could also reach a settlement after HJJ rules on the RR percentage or they could settle while the case us fully up on appeal. That door is, and will remain, open. Whether they ever both cross that threshold is another matter.

I think I have read in the past from reliable posters that HJJ has a history of pushing settlements or maybe a high settlement rate.
I am intrigued by HJJ's schedule of briefs and settlement efforts. My basic belief is that the w/a is not valid. If HJJ wants to "encourage" a settlement he will rule on the w/a quickly to give the settlement meeting by G and V to have some teeth.

I do have a question. Does the settlement conference with the Judge Magistrate require a resolution or can it conclude with a stalemate?
