Its an orphan designation; it aint a lap marker in a Race (regards comment of who is ahead of who FDA vs EMA).

Either way, when EMA ultimately approves it, or any foreign regulatory authority approves it for that matter, and it is within 5 year window of FDA approving it, milestone F kicks in baby!!!!!

f.Within ten (10) business days of CELGENE receiving official confirmation from any foreign regulatory agency (such as the EMA) of approval of the use of the Product in the Field (relying on the Surrogate Endpoints) CELGENE shall make a one-time milestone payment of [***] (US$[***]) ("Foreign Approval Milestone"), provided, however, that said approval takes place within five (5) years of the confirmation from FDA of approval of the use of the Product in the Field (relying on the Surrogate Endpoints).
