The MSJ may be a waste of time, but from a strategy standpoint, wouldn't it be good for Worlds to sit through it and watch Activision try to explain this waste of time to the court? If the judge rules on it before markman, then the MSJ won't overshadow everything that goes on there. What else could Activision possibly have left in its bag of tricks that will get it through the markman unscathed? I believe following through with the MSJ will position WDDD to slaughter ATVI at markman. If I were ATVI, I'd be looking for a way out of the MSJ at this point.
