I'm sure many factors went into Susman's venue decision. Considering that Worlds is based just outside of Boston and that ATVI is based in Santa Monica, CA may have had something to do with it. Maybe they didn't want to fight this in ATVI's backyard and believed the hometown crowd would be best. The Susman Houston lawyers will have to bone up on their Bostonian accents - lol.

As far as your high-risk, low-reward comment, you need to understand that in the prior jury verdicts to which I referred, the juries in those cases were not presented with a $500M-plus damages model. If a plaintiff asked for only $26M, that would be the entire award to which he or she was entitled (unless the judge could have trebled the damages due to the defendant's willful infringement). Here, Worlds will present a much larger damages model that will be supported by objective evidence, including ATVI financial documents, written documents supporting the requested royalty rate range, and expert testimony to explain all of it. Considering that one Boston jury awarded over $226M to an IP plaintiff over five years ago, I strongly believe that a Boston jury could easily award over $500M to a fellow Bostonian in 2014.

The merits of this case are huge. What WDDD plans to ask for in a jury verdict is much more money than what has been asked for previously. WDDD has the law to back it up regarding a percentage of the money made and triple damages due to wilful infringement. In short, the reason this case is so large is because of the fact it is a billion dollar industry which is using WDDD's patents! Load up here and then wait for at least 6 months. You'll be glad you did.

Today looks like a good loading day. One or two of the usual panic sellers who don't know what they own, selling 50,000 or 100,000 shares, a small amount. Not sure why someone would exit now, especially on the precipice of news related to the USPTO correction and a possible change in October 17, but some people just get fidgety. Loading in the upper 20's now; won't be long and such prices will be a distant memory...
