well perhaps they realized its an easier out to say they tested it and realized it didn't work..vs putting some bogus paperwork into the court system where the judge will not be happy.
perhaps they have finally wised up and realized they are done, minimize damages but don't piss off JJ bc he is at the end of his rope with their nonsense.
