I am not sure under what circumstances a Federal question would arise as I am not a lawyer nor do I attempt to portray a legal expert.
But if you could cite some specific cases where this set precedant and this point would affect the final outcome of this particular case it would be fantastic.
If not I would guess it does not matter much at all.
