Judge Jackson might be abducted by aliens, too, and as a result never rule on the ongoing royalty issue. Is that a reason to think he won't make a ruling sometime soon?
A potential CAFC ruling on the issues currently under appeal is months and months away and extremely unlikely to come out before Jackson's ongoing RR ruling. And the odds are against it overturning the jury or going against VRNG on the core issues relating to damages, or anything else that would potentially render the District Court's impending RR ruling moot.
Most likely, the ongoing RR ruling will be issued first, be appealed by one (or both) parties, and eventually get consolidated with the current CAFC case. But nothing in litigation is for certain, so we wait and watch what happens.
