Many, many companies have tried shortchanging Apple that way.
None got away with it for long.
It's been tried for E-book sales, podcasts, e-mag subscriptions. Apple has been sued over it.
Apple wants a 30% cut of any sale related to an app sold thru its App Store.
Although it is possible to distribute iPhone apps without using the App Store, it is generally impractical, except for small in-house distributions in a small company, or for Beta testing purposes.
