First get the motion to dismiss denied.Thats a victory.The judge can stop this tomorrow if he feels its a matter of law.

Good question about summary judgement, ILNS may not have asked for a summary judgement so my guess is the case goes to trial as stupid as the defense argument seems. I am not diminishing the need for ILNS funding but my guess is if they wanted one they would have asked. So ILNS may have hidden reasons such as the longer the case the greater the damages and the much needed media attention.
