For it to be a dietary supplement (and get the dietary supplement FDA exemptions of registration and approval), it has to be "ingested" and therefore cannot be marketed as sublingual. From all the interviews of the company and the descriptions on their website, I do think sublingual is the intended application method, but they cannot market it as such on their product.
