In March I was contacted by Systems Evolution Counsel Theodore Max with regards to the settlement in the remaining matter in this case. Mr. Max suggested that I prepare a Settlement Offer in the form of a Settlement Agreement.
On April 30th, 2013, I submitted a draft of the Settlement Agreement to Mr. Max.
On May 13, 2103 Mr. Max responded to my email and indicated that "given the timing of the matters and the fact there were
questions, I contacted the Court and the matter was returnable
tomorrow at 10:15 AM has been adjourned until June 25th, 2103".
Mr. Walters, who was a party to this case entered into a Settlement Agreement with Systems Evolution and the company
has since defaulted on the agreement. Walters has now executed a Federal Writ of Garnishment against Systems in Arkansas and ceased their bank accounts. It may be for these reasons I have not heard form Mr. Max, as it appears things are in turmoil in
Arkansas.
