I agree it was an error by the jury. I also agree with you that it will not be corrected at the trial court level. The court has already ruled on it and the error, if any,can only now be corrected by the court of appeals decision. IF the court of appeals believes it to have been in error, that would result in a remand for a mini trial on that damage issue, IMO.
