Piratica--I’m well aware of the Google-Obama political connection and comments, but am hoping, as are all of you, that this proves to be immaterial. I keep asking myself how the 8-month delay in final ruling has added to what JJ could have done immediately after the jury decision in this case. As a legal matter the cases recently cited are the same darn ones we were looking at from the beginning. If one reads the law review articles and cases that applied in patent infringement litigation pre-trial nothing essential has changed. Nothing. It’s true that the prez and White House have commented on “patent trolls” and cited poor lil’ picked on Google, but I’m talking about LEGAL, not political considerations.
I’m still hopeful. I’m trying not to be conspiratorial. I’m hoping that these delays that seem so needless are based on reasons that have nothing to do with political commentary. In my day, politics was the last thing lawyers even remotely considered in trying to gauge how a judge would rule. I’m still hoping and trying not to be cynical (and betting some big bucks) that things haven’t changed. Legally we should be in a very strong position here. I'm still looking at at least a 5% RR based on 20.9% revenue base.
But WHEN will JJ finally rule? I dunno. GLTA.
