Why would HJJ care about VRNG making deals with MSFT, or ZTE? Whether or not they have the capacity to develop a search engime should have no bearing on how he rules. That makes no sense to me at all. HJJ is supposded to be handing down a judgement based on the merit of the arguments made by both sides regarding a RR.
I agree with Keith on this one piratica. What VRNG does outside of the courtroom has no bearing on what occured during the trial. All the judge is responsible for is applying the law according to what happened in his courtroom. That's why Google's motion for leave is a moot point. It has zero bearing on the remaining motions before him.
