because it's a bankruptcy play. the paxton intervention is how monte v. paxton (wgas) is described in the disclosure statement.

interventions are asset purchases in BKs.

the trustee in the BK case has been given a summons to appear in our case.

as long as the trustee's creditors get paid, he will be happy.

volk raised the AS the same day the preferred shares were created, and on the same day the debenture holders (who financed VM) were given a summons to appear in monte v. paxton.

we know now from the filings that the preferreds are for voting rights.

They could have simply foreclosed. Badabing, done. Volk wouldn't have had a leg to stand on.

Why didn't they? It's much easier. Why sue? To rescind the sale? They could have just foreclosed on it.

I wonder why.....

Please let us know why they simply didn't foreclose on VM. Once that is figured out, you will have your answer.
