I looked at the Patents Circuit Court Web Site this morning and did not see that the judges ruled using a Rule 36 Affirmation. My partner told me they had 48 hours to use Rule 36. Had the judges used this rule they would have been saying that they have seen and heard enough and the judge in California made no errors. This probably means DECN has won this point and we will see in the coming days how big the win is.
