I for one do not misunderstand the lawsuit. Further I have never asked Chaya to come onto this forum and answer anything. I have said I believe in the technology and that I believe she knows a lot more than us and what is going on behind the scenes but I have never asked her to come on here and tell us what it is. Because of my belief in the technology and the ability for her to bring it to fruition - I invested.
Your statement...."Had MC/V be honest, SMME would have been a revenue producing company....that is why the damages are being asked for".
Due to the fact that I'm such a simple person isn't the matter before the courts to determine whether V & MC have knowingly or otherwise used a registered patent in the production of their cards?
If its proved they have then once this fact is established it is up to the court/jury to decide the level of compensation/damages to be paid to the holder of the patent.
To determine the amount of compensation the courts have to decide compensation in 2 forms.
1) Lost Profits 2) Reasonable Royalty
I ask - Does SmartMetric's claim fall within both of the above categories?
I don't know!
We know the status of production. There isn't any. Does this affect either category of a Patent claim?
I don't know!
The temerity of our claim may be based on one or more of the governing determinants.

11 years and still .... there's others been in longer than that, and I'd guess that applies to most of you.

A point about the card which hasn't been mentioned for some time, probably as it doesn't appear to have anything to do with the court case - the embedded fingerprint activation, and on-board storage - that is the single biggest asset of the card which convinced me to invest.
