That is how i understand the sec docs, cap on past damages only!

The jury, and judgment, also awarded RR 3 1/2% against Google, and the judge signed it and made it a judgment under Rule 59. I think the MSFT settlement includes the RR, past and future.

This brings up an interesting point. Does the settlement cover future royalties? It covers the settlement of past damages as alleged in the complaint, but perhaps not future royalties. Another question to be answered definitively.
