piratica, please read my post again in answer to yours regarding the appeal. Those are the current timelines to my knowledge, unless and extension has been requested and granted. VRNG appellate brief is due June 3rd. 30 days later GOOG's response brief is due. 14 days later VRNG's reply brief will be due. There are variables, but that's the basic scenario on what will be filed in the appellate court. Oral argument will likely be requested, IMO, and the appellate court may very well grant that request. When the appellate court actually sets that oral argument to take place is anybody's guess. I haven't even attempted to research how long they usually run to set a case for oral argument so I really can't answer your question at all on that. Might be weeks after VRNG's final reply brief, but may be months. I honestly don't know their normal timeline. I think they average around a year from the time an appeal goes up to them, the best I recall,before they actually issue their opinion. There is no absolute timeline. I THINK I recall that this appellate court rules on an average of about 6 cases a week, but I could be wrong. They have many cases that come before them, and this one is just another one. Nothing special about this case to make them jump through any hoops to rule on it any sooner.
That's about the best guess I can give you. Someone more knowledgeable may be able to give you a better opinion. I'm just a layman, so always bear that in mind. I have NO LEGAL OPINION about ANYTHING concerning this case, nor any other. I've never worked for a firm that practiced patent law, and 99.9% sure I never will. I'm just a lowly legal assistant my friend, with LAY opinions that may, or may not be, right. I've done my best to answer your questions posed to me, but I've offered you about all I can on this issue at this point.
I LIKE where we are, and I think we will make a nice profit, provided HJJ gives us a nice ruling. IF he doesn't, or something weird comes out in his Order, the stock will tank, IMLO. If he gives us 5% of 20.9%, or better, I think it will fuel a nice move North. I have NO IDEA what he will do. I am hoping he follows the evidence presented at trial and disregards the jury percentage apportionment on past damages. If not, we sink and we all get our asses slammed, IMO of course. There are no guarantees here, but I DO like the odds. I am NOT ALL IN, but I have a substantial stake here.
