Looking at this from a purely business standpoint G has been consistent in their approach. Limit their damages and drive up the cost for V. While G seems to have a weak hand they have been clever in their responses. Now V has the opportunity to turn the table on G using G's cleverly crafted retorts.
Additionally, the HJJ has the same opportunity to to slam the door on G with a oversized RR...since G has this "workaround" it should not matter what the RR is going forward, G has stated they will not have to pay.
V has been equally as clever in the responses in the past; it will be interesting to see how they use G's arguments against them. With any luck V will slam the door shut on G...hopefully with their head in it.
I'm sure that JJ and other lawyers or just those that stayed in a Holiday Inn Express last night, will give us some good insight on the retort.
