A common stock class action suit is breach of fiduciary responsibility and due care to common stockholders (owners of the company) and may be one of many options if a class action suit evolves. Hopefully, a buyout/merger will stop any need of having one.

When you buy stock in EK, you buy the stock in the whole company

and the CEO is trying to through the common shareholders out by BK-ing the US interest only while hiding over a $1 billion plus in cash in Europe and Europe is not BK. Are Kidding Me, every shareholder should be pissed.
