A Markman establishes precedent for the portfolio. It can be overcome but it is rather difficult. I would never invest in anything that had to fight that uphill battle.
VHC has had three Markman hearings already. The MSFT Markman and Apple/Cisco opinions had little differences but were basically the same at the end of the day. The Mitel/Siemens/Avaya Markman opinion was almost word for word the Apple/Cisco opinion. I think only one or two words were changed. Nothing that mattered.
