Agreed and to add to workaround theory which I mentioned before was directed at Microsoft. Why because they are competitors and do not want to be paying royalties to a competitor. So they where saying if you Microsoft get your hands on these patents we will do everything possible to make them worthless. It's not near as bad to pay a third party as it is to be shelling out profits to a direct competitor.

The chance for willful is out the window at this stage of litigation. It can not be brought back into the picture. Its over. It doesn't matter if God bought the patents and took over the case. It is impossible to bring willful into the case.

as much as I value your comments and insight, I do NOT think the workaround represents a new strategy for GOOG for the following reasons: Firstly, it is common strategy for infringers. Secondly, workaround is specifically mentioned as a reason for GOOG requesting a delay in post judgment RR in their filing #853.

so, with these two pieces, can you clarify why you feel the workaround is a new strategy??
