I have nothing against PEIX shareholders just management, like NK, for walking shareholders into a litigation buzzsaw in the near future(this year). Could be next week.

I hope I've helped PEIX investors learn the implications involved with a public company infringing issued and valid patents. I hope they're more educated on the extraction process, how it came about, and who ICM got the technology from. They should be aware by now of who is doing what yields. The fact GPRE can do .90 and PEIX, REX, and VLO are still stuck at .55 should tell them right there who invented it.

These patents have been reviewed and reconfirmed valid by the USPTO. The court's laughed at ICM's prior art, didn't let DVG off the hook, and dismissed ICM's claims against GERS. ICM's summary judgement was denied on the basis the patents would be reinterpreted very heavily in GERS favor.


PEIX is using both the advanced oil from ICM and the oil plus from Edeniq, without a license. GERS is promising action against unlicensed producers using both these systems this year, in the coming months even.


“We have looked at the so-called advanced oil, oil plus, COSS and such other attempts to work around our patents. We are highly confident, and even more so with this latest ruling, that all such attempts plainly infringe our patents.”

As we expand the litigation this year, ...we've reserved cash for this purpose.

Make no mistake about it, the patents will prevail...
